Afghanistan wants clear rules on jurisdiction for U.S. military
The project to maintain the presence of a contingent of American soldiers , consisting of a number between 8,000 and 12,000 units in Afghanistan , the result of an agreement reached in a difficult between Obama and Karzai, must undergo the traditional Afghan Grand Assembly . The body, made up of about 3,000 people, is made up of tribal notables and non- elected personnel , and has a great power that can enable you to override the decisions also considered not conform to the constitutional tradition . However, the choice of components has been carried out exclusively by the government, so that it can boast of relative safety on the fate of the decisions to be taken . The Afghan president has proved increasingly opposed to a total abandonment of American troops , specifically because he fears the return of the fundamentalist militia , and with it the end of the democratization of the country of Afghanistan. Obama, who had promised total withdrawal of U.S. troops , it seems to have realized the inadequacy of the government armed forces , the military force of which still have the rebels and danger for the United States itself , in the hands of a return to Afghanistan radical extremism . A danger which would constitute the basis for secure groups and terrorist activities to be exercised against the West . Despite all efforts , in fact , Afghanistan is far from certain even with the presence of American and completely abandon it would mean wasting all the efforts made so far. To accept the continuation of the American presence in the Afghan society , Karzai has to give the green light to a set of rules that regulate the activities of the U.S. military under the law of the country , never to be seen again, at least from the point of view legislation, such as the invaders, sentiment shared by most of the population and that is an obstacle not just to stay American . The crucial issue for Washington is to protect the Afghan legal system of its own soldiers , a special jurisdiction which is seen as a violation of the sovereignty of the state of Afghanistan. The draft of the agreement should provide for the exclusion of the application of the law of Afghanistan, replaced by the American Association for the direct dependents of military and civilian Department of Defense , which can not apply to foreign employees of companies operating in the sector and safety of contractors in general. Another aspect will cover counter-terrorism operations , to be conducted jointly , then by mutual agreement and coordination with Afghan forces . According to some analysts with these measures Karzai seeks to protect itself from any criticism that may come from the environment against the American stay in the country. For the rest of doubtful and controversial aspects emerged during U.S. military operations there have been many , especially in those cases that have seen a number of civilians casualties , involved in military actions against their will by mistake or even cruelty. Just these cases, of which , in large part, have not been made public offenders , have attracted major criticism not only of Afghan society, but also of international organizations and humanitarian organizations operating in the country . It is no coincidence that Amnesty International has suggested that the traditional grand assembly that is inserted in the laws of Afghanistan responsible for the conduct of the U.S. military . The need for better protection of human rights for the people of Afghanistan , often the victims of air strikes and night operations poses a clear need for the extension of legislation to expand to other theaters of action concerning foreign troops , not just U.S. , of which the United Nations should assume , engaging the countries that have used the armed forces on foreign territory in respect of civil liability and the possible adoption of some of the errors and violations committed .
