Egypt towards a new constitution

The new constitution that Egypt is preparing to submit to popular referendum , compared with a divided country and still trail by violence , a situation that the action of the military government has failed to pacify . The development of what will be the new fundamental law of the Egyptian nation , was made at a particularly difficult moment in history , both in the political situation , which for the economic and social crisis , which, although already present , escalated with the overthrow of the Islamist government legitimately elected . The constitutional referendum will be a very careful examination to assess the feelings of the Egyptian people , especially the part related to the world of religious parties , which have been the subject of harsh measures , such as the outlawing of the Muslim Brotherhood movement . The document prepared by the committee made up of representatives of the 50 companies in the country , despite having deleted the definition of an Islamic state , has left a rather vague definition of what that can mean religious party , leaving , in fact, the possibility of the existence of these formations based on ' Islam and, therefore , allowed to maintain a channel of dialogue between the secular government , the military and members and sympathizers by religious movements . It is , of course, a last attempt to retrieve a comparison abruptly ended with the arrest of Mursi and always refused on the basis of illegitimacy than that for Islamists , it is considered without any doubt , a military coup . However, just the most important part of the religious politics , the Muslim Brotherhood movement , comes the official rejection of the constitutional text drawn up , because it was considered without legitimacy. Keep it up , on the same yardstick for comparison, the rejection of dialogue with the government, resulting in a substantial block of what should be the political discourse . In this state of affairs contributes to the fact that it is not yet clear how the Muslim Brotherhood , for all their importance in the country , may, and in what form, participate in the upcoming parliamentary and presidential elections , because all their staff is in prison. It is also not seen in a favorable setting of the new constitution , which eliminates the religious character of the previous fundamental law , which is expressed in the fact that the legitimacy of the law shall no longer be subject to the compliance of Sharia , but concerns the jurisdiction of the Court constitution, on the model of western constitutions . Of course the army which is the subject of strong Egyptian politics , maintains its prerogatives , thanks to the measure that protects the defense minister , whose appointment process or revocation , requires the President to consult the Supreme Council of the Armed Forces is understand how , in this way , it reinforces the role of the military since the Constitution. In addition, one of the most disputed is the possibility for civilians to be tried by military courts in certain situations, the device that provides additional power to the armed forces and is under heavy criticism from the secular part of most politicized , as the young revolutionaries , who initially supported the fall of Mursi, siding with the government of the military expression . Indeed, there are campaigns , from this part of the policy, which are contrary to the new constitution , because it is too centered on the role of the armed forces . But , if on the one hand, these criticisms are shared, especially on the theoretical level , it should be recognized that the armed forces are the only political entity capable of countering the Islamist drift that had taken over the country, trampling on the rights of minorities, with a misuse of electoral victory . The impression is that the Egyptian society , contrary to a confessional setting of the country , while making themselves fully into account the imbalance of power in favor of the military, in the end choose for what is considered the lesser evil , waiting for the maturation of society towards a greater democratization of the country, in essence, waiting for better times . These aspects are also largely shared by professionals who recognize the new text added protection of rights and freedoms , such as gender equality, putting into doubt the strong Islamist government , the rights of children , respect for international treaties on human rights. These are important elements, whose explicit recognition is a step forward, even if the role is too important to the military and given the possibility of more restrictive laws , such as those relating to events constitute serious doubts on the course of full democratization of the new constitution .
