Tunisia towards new constitution

The country from which they match the Arab Spring , Tunisia, is preparing to launch the revision of the constitution. In fact the process , started in October of 2011 , must have been thoroughly completed, but the severe instability of the country, affected by severe social conflicts and the rise of fundamentalist movements , has suffered repeated stops. The negotiations between the political forces demanded patience and sacrifices for all parties involved in the drafting of the constitution , because of the large differences between the different points of view exist . However, the shared commitment of the political class of the country was to conclude the process of adoption of the Basic Law by the historic date of January 14, 2014 , the third anniversary of the ouster of Ben Ali. The goal is to get the approval in parliament , getting two thirds majority of the 217 members of the Assembly to avoid the referendum , that would be a failure for the representatives elected by the people . With the adoption of the new constitution Tunisia could finally get out administrative stillness followed the murder of an opposition MP , which took place on July 25. In fact, the new rules should lead to the resignation of the incumbent government , elected by the old law and lead the country to new elections in 2014 . Materially the establishment will consist of a preamble and 146 articles, although more than 200 amendments were presented with the purpose of introducing Islam as a source of law , but the odds on the success of these intentions seem to be very few . They were introduced principles that limit the power of political office , according to the experience with Ben Ali, and mechanisms have been introduced by law for the protection of the constitutional organs . In the field of human rights has been expressly provided for freedom of speech and assembly and the right to strike. For class Tunisian political ambition is to create a card attesting to Tunisia as the first Arab democracy , and that it can serve as an example for other countries that have followed a similar path . Despite these intentions, which represent a step forward in the process of democratization in Tunisia , in particular, and the Arab countries in general, non-governmental organizations , including Amnesty International and Human Rights Watch have found that the rules relating to human rights are vague and do not take precedence over national laws , also the equality of the sexes does not seem protected enough . These findings denote as the Islamic component is still crucial in influencing the process of progress towards democracy in the Arab countries , it is a cumbersome presence able to slow down the construction of a law that knows how to fully protect the rights of all the people and aims to preserve some room for maneuver in the Arab societies , in order to exert its action . In the eyes of Westerners is difficult to understand how this could happen in countries that have long been squeezed by fierce and also dictators who are at risk , as did Egypt, to find himself in a new form of government , but the great support they enjoy Islamic movements in the population is due to the fact they have often represented during the dictatorships , the only form of opposition in touch with the people , paying a high price for this activism . Their vision of democracy, at this time, can not be equal to the laity and even less to Westerners , but the fact that they accept the compromises with political forces adverse to build a common ground , denotes a desire not to go back to forms most illiberal government . If this project succeeds Tunisia, the smallest country in the Arab world , will gain even more prestige as an example of the way and coexistence between secular and denominational world , united on the broad principles to guide a country and be able to provide its assistance to countries considered most important , who are still unable to draw up a dialectic between the parties at this time very distant .
