The need for regulation in international law the use of drones

The allegation of Amnesty International on the legality of attacks by the armed forces of the United States , through the drones , unmanned devices from remote locations without any human personnel on board, reopens the question of the legality of the use of such a weapon , the ability to configure of the offense of war crime. For the U.S. military drone weapon is relatively inexpensive , which ensures a certain degree of precision , and above all does not employ staff directly in the field , thus avoiding the high costs of training and exercise , and possible loss of life, who have so much reflection on feelings of public opinion. However, what is the highest weak armament is the assessment of the objective, the operator , or his superior, are seated in comfortable positions to thousands of kilometers away. Often this assessment, about the real danger of the lens is totally wrong and causes the death of innocent civilians , who only have the misfortune of being mistaken for terrorists. These incidents , according to the charity , they would grow considerably, especially in the tribal area of Waziristan , located in north- west Pakistan , but would also have occurred in other theaters of war , including Yemen. The biggest problem is on the operating of these acts of war within international law, in fact, the lack of transparency of the American conduct does not allow an action, even as a hypothesis , the prosecution of the crime by the international courts. Of these modes of attack the U.S. military drop a level of impenetrable secrecy , which does not allow to trace the responsible and therefore, for the state of the victims or their relatives , it is impossible to obtain justice . It does not appear that any U.S. official has ever been prosecuted for the mistakes made by the drones , in the international arena . Yet the U.S. is aware of the problem : President Obama, since May 2013 had promised greater transparency on the use of these deadly weapons , that promise has not been kept , without changing the mode of operation of the equipment homing missiles. The issue is that international law has not yet adapted to the technological innovations in the military and their use , as well as the regulation of the nebula is still asymmetric conflicts , ie those between sovereign states and paramilitary organizations , the expression of terrorist movements . In these gaps are part of the actions taken by the drones , which do not allow a real persecution of those that can be defined incidents effects: incorrect identification of objectives, which causes the death of innocent civilians. This aspect , which is central in the complaint of Amnesty International, is never admitted by the United States , which only admit that they have always been struck by terrorists. In addition, Washington would have the support of other powers in these actions , in fact you suspect the cooperation of states such as the UK , Australia and Germany. If this were true the need to give international regulation to the use of these weapons , it would be even more pressing by the number of players involved. It is not to neglect the aspect of urgency to fill this gap in international law, due to the relative low cost of the drones , which leads us to predict a spread of these weapons on an increasing scale , with the risk that terrorist groups it can be equipped . If you can understand , but not share the current reasons the United States to be reluctant to broach the subject in an institutional setting , such as the UN , the importance of the above factors , which determine an increasing use , must also be considered overt appearance of illegality when the targets are incorrect and also the emotional aspects that arouse in the public opinion, which may become obstacles not easy to handle . Finally, the high number of casualties that the drones cause , they can not go unpunished , in the context of the fight against terrorism , which , it seems increasingly cause the same effects of the attacks : the death of many civilians .
